1. Acceptance of Terms

By creating an account, making a purchase, or otherwise using the Platform, you represent that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms form a binding legal agreement between you and Canalytics Shop.

2. Eligibility

You must meet all of the following conditions to use the Platform:

• You are at least 21 years of age.
• You are a resident of a U.S. state or jurisdiction where the purchase and use of hemp-derived CBD products is lawful.
• You have the legal capacity to enter into a binding contract.
• You are not barred from using the Platform under any applicable law.

By using the Platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate accounts or refuse service if eligibility requirements are not met.

3. Account Registration

• You must provide accurate, complete, and current registration information.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account at support@canalyticsshop.com.
• We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
• You may not create accounts on behalf of others without authorization or create multiple accounts to circumvent restrictions.

4. Products, Purchases & Pricing

• All prices are listed in U.S. dollars and are subject to change without notice.
• We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion, including in cases of suspected fraud or error in pricing.
• Product descriptions, images, and specifications are provided for informational purposes. We do not warrant that descriptions are error-free, complete, or current.
• Availability of products is not guaranteed. We may discontinue products or limit availability at any time.
• Promotions, discount codes, and special offers are subject to their own terms and expiration dates.

5. CBD & Cannabis Legal Disclaimer

Our products contain hemp-derived cannabidiol (CBD) and related compounds with a THC content of 0.3% or less on a dry weight basis, in compliance with the 2018 Farm Bill.

• It is your sole responsibility to verify that the purchase and use of CBD products is lawful in your state, municipality, and jurisdiction before ordering.
• CBD and hemp-derived products are not approved by the U.S. Food and Drug Administration (FDA) to diagnose, treat, cure, or prevent any disease or condition.
• We make no representations that our products are appropriate or legal for use in all jurisdictions outside the United States.
• You are responsible for all duties, taxes, and customs fees associated with international orders, if applicable.
• Canalytics Shop is not liable for legal consequences arising from your purchase or use of products in jurisdictions where they are restricted or prohibited.

6. AI Recommendations — Not Medical Advice

Canalytics Shop uses artificial intelligence to provide personalized product recommendations based on wellness preferences you voluntarily share.

• Not Medical Advice: All AI-generated recommendations are for informational and wellness purposes only. They do not constitute medical advice, diagnosis, or treatment.
• Consult a Professional: Always consult a qualified healthcare provider before making decisions about your health, especially if you are pregnant, nursing, have a medical condition, or take prescription medications.
• No Guarantee of Outcome: We do not guarantee that any product will produce a particular result or wellness benefit for any individual.
• Voluntary Participation: Completion of health assessments and provision of wellness information is entirely voluntary.

7. Payment & Billing

• By providing payment information, you authorize us (or our payment processor) to charge the total order amount including applicable taxes and shipping fees.
• Payment is due at the time of purchase. All sales are final subject to our Return Policy in Section 9.
• We use industry-standard PCI-compliant payment processors. Your card details are not stored on our servers.
• If your payment is declined or reversed by your financial institution, we reserve the right to cancel your order and pursue recovery of amounts owed.
• We are not responsible for foreign transaction fees or currency conversion charges applied by your bank.

8. Shipping & Delivery

• Estimated delivery times are provided as guidance only and are not guaranteed.
• Title and risk of loss pass to you upon delivery of the order to the shipping carrier.
• We are not liable for delays caused by the shipping carrier, weather, customs clearance, or other events beyond our control.
• You are responsible for providing an accurate shipping address. We are not liable for orders lost or undeliverable due to address errors.
• We reserve the right to restrict shipping to certain states or regions where CBD products may be subject to additional legal restrictions.

9. Returns & Refunds

Due to the nature of health and wellness products, all sales are generally final. However, we stand behind our products and will work with you in the following circumstances:

• Damaged or Defective Items: If your order arrives damaged or is materially defective, contact us within 7 days of delivery with photo documentation for a replacement or refund.
• Incorrect Items: If you receive the wrong product, we will send the correct item or issue a full refund at no additional shipping cost.
• Unopened Items: Unopened, sealed products may be returned within 14 days of delivery for a store credit, minus a restocking fee.
• Opened consumable products are not eligible for return or refund unless defective.

10. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, product descriptions, AI-generated content, software, and the overall design, is owned by or licensed to Canalytics Shop and is protected by applicable intellectual property laws.

• You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Platform content without our prior written consent.
• You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal, non-commercial purposes.
• User-submitted content (such as reviews) remains your property, but you grant us a worldwide, royalty-free license to use, display, and distribute it in connection with the Platform.

11. Prohibited Activities

When using the Platform, you agree not to:

• Violate any applicable local, state, national, or international law or regulation.
• Use the Platform to purchase products for resale, redistribution, or commercial purposes without authorization.
• Attempt to circumvent, hack, or interfere with the Platform's security or authentication systems.
• Scrape, crawl, or systematically extract data from the Platform without express written permission.
• Submit false, misleading, or fraudulent information, including payment data or shipping addresses.
• Harass, threaten, or harm other users or our staff.
• Use automated tools to place orders, create accounts, or abuse promotional offers.
• Post or transmit malware, viruses, or any harmful code.

12. Disclaimer of Warranties

THE PLATFORM AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS ENTIRELY AT YOUR OWN RISK.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CANALYTICS SHOP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use of or inability to use the Platform or any products purchased.
• Any unauthorized access to or alteration of your data.
• The conduct of any third party on the Platform.
• Any health outcomes related to product use.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

14. Indemnification

You agree to indemnify, defend, and hold harmless Canalytics Shop and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, your violation of any applicable law, or your infringement of any third-party rights.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of [State], without regard to conflict of law principles.

• Informal Resolution: Before initiating any formal dispute, you agree to contact us at support@canalyticsshop.com and attempt to resolve the issue informally for at least 30 days.
• Arbitration: Any unresolved dispute shall be submitted to binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Class action lawsuits and class-wide arbitration are waived.
• Exceptions: Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, for significant changes, by sending an email or posting a notice on the Platform at least 30 days before changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the new Terms.

17. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Canalytics Shop regarding use of the Platform.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
